A Goldstone with a swastika tattoo

Swastikas under sharp suit

Justin Goldstone's red swastika tattoo crept above his collar as he sat in the dock. Sentencing him in the High Court at Auckland yesterday, Justice Forrest Miller queried media reports that he was a prospect for a gang.

New Zealand Herald, May 29, 2010

Defence lawyer David Reece said Goldstone "doesn't accept that, but you will note it is not against the law to be associated with a gang".

He said Goldstone bought his shotgun for protection after threats to report him for benefit fraud.

But the Weekend Herald has learned that beneath Goldstone's smart, dark suit and crisp buttoned shirt yesterday was another tattoo of a Nazi-style swastika.

The words "f*** the police" were also etched into his shoulderblade.

Justin Goldstone

A Wellsford man who accidentally shot his girlfriend dead has been sentenced to three years and four months in jail.

Justin Goldstone shot Samantha Henderson in the head as she took photos of him posing with a loaded sawn-off shotgun.

Goldstone entered the court hoping for home detention, but Justice Forest Millar said the recklessness of his offending defied belief, and that jail was inevitable.

Goldstone had claimed he'd forgotten the shotgun was loaded. The judge said tough.

"I think you were getting a kick out of pointing the gun at the camera," he said. "I do accept that you were doing this for the purposes of having a photograph taken."

Goldstone's lawyer said the shotgun was for self defence, but he didn't have a licence to carry it and it had been illegally sawn-off.

"The reason why it was there was because he'd had threats against him and her in relation to various matters concerning their benefits," the defence argued.

The judge accepted the shooting of Ms Henderson, a mother of one, wasn't intentional. But he also accepted the Crown's position.

"It's almost incomprehensible that he should have his finger anywhere near the trigger of this lethal weapon when pointing it at the face of someone."

The courtroom was packed as Goldstone was sentenced. His family sat to one side, Ms Henderson's the other. Seven of her family members wrote victim impact statements to the court saying Goldstone was supposed to be her protector - instead he showed sheer stupidity and a lack of intellect.

They said he would never fully comprehend their loss.

Goldstone was sentenced to three years and four months, with the judge saying he'd taken into account the guilty plea.

He may appeal.
